Terms & Conditions
Last updated: 19 October 2026
These Terms & Conditions (the "Terms" / the "Agreement") are an agreement between Brightberry Oy, business ID 3625862-8, Puolikkotie 8 A 512C, 02230, Espoo, Finland ("Witty" / "we" / "our" / "the Service"), and any individual who uses Witty.
By creating an account, completing a purchase or otherwise using Witty, you accept these Terms together with our Subscription Terms, Refund Policy and Privacy Policy, which form part of this Agreement. If you do not agree with any part of these Terms, do not use the Service.
If you have questions, contact us at support@meetwitty.com.
1. Who we are
The Service is operated by, and your agreement is with:
- Legal name: Brightberry Oy
- Business ID: 3625862-8
- Address: Puolikkotie 8 A 512C, 02230, Espoo, Finland
2. The Service
Witty offers online self-assessments (such as IQ, personality and well-being tests), personalised result reports and certificates, and an AI assistant that uses your results to give you personalised suggestions. Some features are free; premium features require a paid subscription or a one-time purchase as described in the Subscription Terms.
The Service is provided for informational and entertainment purposes only. Test results, reports and AI-generated content are not medical, psychological, legal, financial or other professional advice, are not a clinical diagnosis, and do not guarantee any particular outcome. If you have concerns about your health or well-being, consult a qualified professional.
3. Eligibility and availability
- You must be at least 16 years old to use the Service.
- You must be at least 18 years old, or have the consent of a parent or legal guardian, to make a purchase.
- You must provide accurate information and keep it up to date.
- The Service is not available to anyone who is prohibited from using it under applicable law or sanctions, and we may restrict availability in certain countries at our discretion.
4. Your account
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. An account is personal and may be used by one person only. Keep the email address on your account current, as we use it to identify your account and purchases. Tell us immediately at support@meetwitty.com if you suspect unauthorised use of your account.
5. Orders and conclusion of contract
Before you pay, we show you the product or plan, the price including applicable taxes, the billing period and any trial conditions. A binding contract is formed when you complete checkout and accept these Terms, the Subscription Terms and the Refund Policy. The price shown at checkout is the price you pay.
We may refuse or cancel an order if we reasonably suspect fraud, misuse of a trial offer or a breach of these Terms. If we cancel an order, we refund any amount already charged.
6. Prices, payment and subscriptions
Prices, accepted payment methods, currencies, automatic renewal, the recurring payment agreement and how to cancel are described in our Subscription Terms. By purchasing a subscription you authorise us to charge your payment method on a recurring basis until you cancel.
7. Delivery of the Service
The Service is delivered digitally; nothing is shipped physically. Access to paid features is granted immediately after your payment is confirmed, through your account on Witty. Test results and reports are available in your account for as long as your account exists. If you cannot access what you have paid for, contact us at support@meetwitty.com.
8. Right of withdrawal and refunds
If you are a consumer in the European Union or European Economic Area, you may withdraw from your initial purchase within 14 days without giving a reason and receive a full refund of all amounts paid in that period. For one-time purchases of digital content (such as a certificate or report) that is delivered immediately, the right of withdrawal ends once delivery has begun with your express consent given at checkout. Details, exceptions and how to request a refund are set out in our Refund Policy.
9. Cancellation and termination
You may cancel your subscription at any time as described in the Subscription Terms; your access continues until the end of the period you have paid for. You may also delete your account at any time.
We may suspend or terminate your access, with notice where reasonably possible, if you breach these Terms, use the Service fraudulently or unlawfully, or if payment for your subscription fails. We may discontinue the Service or materially reduce its functionality with at least 30 days' notice; in that case we refund any prepaid fees for the period after the Service ends.
10. Acceptable use
You agree to use the Service only for personal, non-commercial purposes and in accordance with applicable law. You must not:
- copy, scrape, resell, sublicense or redistribute the Service or its content;
- reverse engineer, decompile or attempt to extract the source code of the Service, or circumvent any security or access controls;
- use automated tools (bots, scripts) to access the Service or to create accounts;
- share your account with others, or create multiple accounts to obtain repeated trial offers;
- upload or share unlawful, offensive, misleading or infringing content, or interfere with the operation of the Service or other users' use of it.
11. Intellectual property
All content, software, designs, logos, test materials and other intellectual property in the Service are owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for its intended purpose while this Agreement is in force. Your personal results and reports are for your own use; you may share them privately but may not use them commercially without our written consent.
12. Privacy
We process your personal data as described in our Privacy Policy, in compliance with the GDPR and other applicable data protection laws. Data of inactive or deleted accounts may be erased in accordance with that policy.
13. Disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law, we do not warrant that the Service will be uninterrupted, secure or error-free, or that test results, reports or AI-generated content are accurate, complete, scientifically validated or suitable for any particular purpose. You are responsible for decisions you make based on the Service.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, for loss of data, revenue or profits, or for issues caused by third-party services, networks or devices. Our total liability for all claims arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence or for fraud, and nothing in these Terms affects your statutory rights as a consumer.
15. Changes to the Service and to these Terms
We may improve, change or discontinue features of the Service, and we may update these Terms. If a change is material or affects your rights or the price you pay, we give you at least 30 days' notice before it takes effect. If you do not agree with a change, you may cancel before it takes effect; continued use after that date constitutes acceptance. The "Last updated" date at the top of this page shows when these Terms were last changed, and earlier versions are available on request.
16. Complaints and dispute resolution
If you have a complaint, please contact us first at support@meetwitty.com. We aim to respond within 5 business days and resolve most issues quickly.
If you are a consumer in the EU/EEA and we cannot resolve your complaint, you may refer the dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta, www.kuluttajariita.fi) after first contacting the Finnish Consumer Advisory Services (www.kkv.fi), or to the consumer dispute resolution body in your country of residence.
Nothing in these Terms limits your right to dispute a card payment with your card issuer or bank.
17. Governing law and jurisdiction
These Terms are governed by the laws of Finland.
If you are a consumer, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
18. Language
These Terms and our other policies are written in English, which is the primary language of the Service and of our contract with you. Translations are provided for convenience only; if there is a conflict, the English version prevails to the extent permitted by applicable law.
19. General
- We may assign or transfer this Agreement, including to an affiliate or to a successor in a merger or sale of our business, provided that your rights are not reduced. You may not assign it without our consent.
- If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in force.
- These Terms, together with the policies referred to in them, form the entire agreement between you and us regarding the Service.
- If we do not enforce a provision, that is not a waiver of our right to enforce it later.
